This document governs the procedures for exercising the right of withdrawal for purchases made on https://kart-cosmetics.com/en.
Sales contracts are concluded with For Nails & Beauty SRL, the owner of the website and the seller of the products and services offered, in accordance with Articles 52 and following of the Italian Consumer Code (Legislative Decree No. 206/2005, as subsequently amended).
The right of withdrawal is granted exclusively to the Consumer Customer, namely a natural person who purchases goods for purposes unrelated to any business, commercial, craft, or professional activity.
The right of withdrawal does not apply to purchases made by professionals, companies, VAT-registered businesses, or persons purchasing within the scope of their professional activity, unless otherwise agreed in writing.
The Consumer Customer may exercise the right of withdrawal within 14 days from the date of delivery of the products, without being required to provide any reason.
To exercise the right of withdrawal, the Customer may use the dedicated electronic function available on this page by completing the online form and confirming the request by clicking the "Confirm Withdrawal" button.
Upon submission, the system will automatically send an acknowledgment of receipt to the email address provided by the Customer.
The acknowledgment of receipt merely confirms that the communication has been received and does not constitute automatic acceptance of the withdrawal request. Each request will be reviewed by For Nails & Beauty SRL in accordance with the applicable legislation and these General Terms and Conditions of Sale.
The products must be returned without undue delay and, in any event, within 14 days from the notification of withdrawal. They must be returned intact, unused, complete with their original packaging, accessories, any complimentary items received, and all other components supplied at the time of sale.
The Customer shall be liable for any diminished value of the goods resulting from handling other than what is strictly necessary to establish the nature, characteristics, and functioning of the products.
Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for sealed goods that are not suitable for return for reasons of health protection or hygiene if they have been unsealed after delivery.
Accordingly, cosmetic products, creams, serums, masks, cleansers, liquids, products intended for contact with the skin, or any other sealed products that have been opened, used, tampered with, had their safety seal removed, or are otherwise no longer suitable for resale for hygiene reasons, cannot be returned.
Professional tools and accessories that come into contact with the skin, nails, or other parts of the body may be returned only if they are intact, unused, unaltered, complete with all accessories and, where applicable, with the safety seal fully intact and in their original packaging.
The right of withdrawal is also excluded for products that have been custom-made or clearly personalized at the Customer's request.
For online courses, webinars, recordings, digital content, and other digital services, the right of withdrawal is excluded where the performance of the service has begun with the Customer's express consent and the Customer has simultaneously acknowledged the loss of the right of withdrawal, in the cases provided for by the applicable legislation.
Once the returned products have been received and verified as complying with these conditions, For Nails & Beauty SRL will process the refund within the time limits established by law, using the same payment method used by the Customer for the purchase, unless otherwise agreed between the parties.
For Nails & Beauty SRL reserves the right to withhold the refund until the returned goods have actually been received or until the Customer has provided evidence that the goods have been shipped back, whichever occurs first.
The direct costs of returning the products shall be borne by the Customer, unless otherwise agreed in writing or otherwise required by the applicable legislation.
These provisions do not in any way limit the rights granted to the Consumer under the statutory legal guarantee of conformity provided for by Articles 128 and following of the Italian Consumer Code in the event of defective or non-conforming products.
